1. INTRODUCTION

The hiring of services through the www.wearejeff.com website,  property of  MR Jeff LABS HONG KONG LIMITED. (hereafter, the service provider) shall be governed by the following terms of the contract. Acceptance of this document implies that the user has read and understood the content; having sufficient capacity to engage in and assume all obligations set out in this document. 

These conditions will apply to contracts made through the www.wearejeff.com  website, owned by MR Jeff LABS HONG KONG LIMITED. The service provider reserves the right to unilaterally modify these conditions without affecting the services or promotions that were provided prior to the modification. It is the user’s responsibility to read the terms of the website regularly. The service provider hired by the user is MR Jeff LABS HONG KONG LIMITED ("Jeff") with fiscal number 70578885-000-04-19-2. and registered office on Unit 1411,14/floor, Cosco Tower, 183 Queen’s Road Central, Sheung Wan, Hong Kong.

The user, registered on the website with a username and password for which they have full authority, is responsible for the accuracy of the personal data supplied to the service provider.

2. ORDERING OBJECTIVE

The purpose of this contract, once accepted, is to regulate the contractual relationship between the service provider and the user during the online ordering process. This relationship involves delivering a specific product or service for a certain price as well as public exposure through the website.

3. RECRUITMENT PROCEDURE

By accessing the services, the user will create an account, and its data will be sent to the email associated with the requested service. To do this, the user must freely provide the required data. Thus, the user makes diligent use of the generated username and password, not making them available to third parties, as well as to tell the service provider of their loss, theft or possible access by an unauthorized third party, to have it blocked immediately. It is stated, that in accordance with the requirements of RA 8792 (The Electronic Commerce Act of 2000) and  RA 7394 (The Consumer Act of the Philippines) the procurement procedure will follow the following steps:

Request home collection and delivery directly from the app and website by entering a complete address. Log in with Facebook, Gmail or an email address, select a service or subscription, enter an address and a time and day for the collection and delivery. The drivers will come to the given address to collect the items at the scheduled date and time. 

On placing the order, the type of service will be indicated. If Jeff makes an objection regarding the condition of the garment being delivered, the customer will be contacted to authorize its cleaning, who may also record the observations deemed appropriate. 

The customer pays in advance by entering their bank details with a bank card or Paypal on the website or app. Payments can be made with Visa or Mastercard. To minimize the risk of unauthorized access, the card will be encrypted. By paying, the user confirms the card used is subject to verification and authorization by the issuing entity. If the issuing entity does not authorize the payment, Jeff will not be responsible and will not formalize the service. Cash payments may also be made once the garments are collected from their home.

In the case of faults in cleaning, the customer may request another wash via email at info@mrjeffapp.com. This will be recorded in the deposit receipt . The maximum time to do the second wash is 48 working hours, counted from the delivery of the garment to the indicated address.

The subscription does not have a permanence obligation. The maximum time period to unsubscribe is 3 days before the end of the subscription month (which has a duration of 4 weeks, 28 days). Unsubscribing is done through the app or via email, info@mrjeffapp.com. This will not be confirmed until the customer receives the corresponding cancellation email.

If the customer wants to modify the time or date of collection or delivery, they can do so up until 6 hours before the service is provided. Modifications made less than 6 hours in advance will incur a charge, such as when the customer is absent when their clothes are being delivered.

In any case, a Jeff team member will inform the customer via email, once the process has been completed, regarding all the characteristics, price, hired date, collection and delivery time, as well as the corresponding addresses for the service. An order is not complete until it is confirmed by Jeff via an enabled email. 

4. DELIVERY OF GARMENTS

The garments will be delivered at the designated delivery address. The service provider assumes no responsibility if the delivery of the product or service does not take place as a result of the data provided being false, inaccurate or incomplete, or if delivery cannot be made due to reasons outside our delivery service, such as the recipient being absent. Notwithstanding the foregoing, the service provider shall take the measures required of a diligent trader so that delivery can be made at the agreed time. If this is not the case, as soon as possible to the satisfaction of the delivery person and the recipient, so no liability may be held against the provider.

5. PRICES

The prices shown include VAT and other applicable taxes, and will be expressed in US dollars. In addition, prices include handling, wrapping, insurance of shipments and any other additional services and annexes to the requested service. Prices will be published on the website and app, and automatically applied by the procurement process in the last phase.

The customer will be notified via email about any payment made to the service provider. If the customer wants their invoice, they can request it via billingtr@mrjeffapp.com  in the name of the registered user. The customer has the info@mrjeffapp.com email if they require any information about the services provided by Jeff.

6. CLAIMS, LIABILITY AND COMPENSATION

In any case, the maximum time period for claims is 48 days, counted from once the garment is delivered to the indicated address and the completion of the cleaning service. 

Customer claims based on requests for compensation for the loss or damage of a garment subject to cleaning may be resolved with Jeff’s insurance.

The dry cleaners will be liable to the user in case of loss or damage of the garment attributable to bad handling. Checks will be carried out using reliable video surveillance and electronic labelling methods. In this case, the cost of repairing the garment will be covered by Jeff.

In cases such as these, the dry cleaners will compensate the customer for the value of the garment according to the invoice, discounting the following amounts as maximum wear values referring to the date of the invoice.

Less than one year → 20% of invoice value

From a year and a day to two years → 40% of invoice value

From two years and a day to three years → 70% of invoice value

More than three years and less than five → 75% of invoice value

Once the compensation process has begun, the customer has 10 working days to send Jeff all the documentation deemed appropriate and facilitate the valuation process of the garments in order to be able to offer an amount that is as close as possible to the current value of the garment.

By default, the compensation will be equal to the amount agreed between Jeff and the customer. The compensated garment will remain available to Jeff. 

Equally, designer or haute couture garments will be subject to expert evaluation. The amount shall be assumed by the dry cleaners if it is attributed to bad handling. 

Once the amount to be compensated has been determined, the customer will be sent an acceptance document. They will have 15 days to accept or reject this amount and that way, Jeff can proceed to make the payment.

7. USE OF THE WEBSITE

The user agrees not to misuse this website, such as the intentional introduction of viruses, Trojans, worms or any harmful programs or software that would damage Jeff’s system, as well as attempts of unauthorized access to the server, computers, devices and databases. Failure to comply with this condition may lead to the declaration of criminal offences typified by the legislation in force in the matter.

8. DATA PROTECTION

The data provided by the customer is protected in accordance with our privacy policy published on http://www.wearejeff.com /info/ph/privacypolicy/

9. SENDING OF PROMOTIONS AND OFFERS

During the registration process, you agree to receive promotional emails from www.wearejeff.com . You can opt out of receiving these emails by clicking on the link at the bottom of any promotional email.

Likewise, during the registration process, you expressly authorize us to call and send you text messages for marketing purposes. You will always have the right to revoke this consent by sending an email to info@mrjeffapp.com, where you can express your desire to no longer receive these calls and messages from our marketing team.

This is in accordance with RA 10173 ( the  Data Privacy Act of 2012) as well as the RA 7394 (Philippine Consumer Act) establishing the operation rules and functioning of the Public Registry of Consumers.

10. USER COMMUNICATION

Any information sent to www.wearejeff.com , including but not limited to questions, criticisms, comments or suggestions, will become our sole and exclusive property and will not be returned, unless ordered by the court. When such material is submitted to the site, we are granted the right to use the name submitted as part of that review, commentary or any other content. Lastly, it should be added that a fake email address should not be used to pretend to be someone else.

Customers whose personal data have been collected may demand the return or deletion of their personal data. The data submitted to www.wearejeff.com  to register various accounts in order to benefit from promotions for new subscribers will be cancelled and dismissed immediately. Any attempts made to access any profit from promotions will be cancelled, and the attempting subscriber may have their license revoked at the time of subscription, canceling any product orders placed without any liability on our part. 

11. APPLICABLE LAW AND JURISDICTION

For the interpretation and enforcement of these terms and conditions, the parties submit to the jurisdiction of the courts of the Philippines, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future addresses.

These conditions shall be governed or interpreted in accordance to the laws of the Philippines in matters which are not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these terms to the competent courts and tribunals.
